Please read carefully. By signing below you acknowledge that you have read, understand, and agree to the terms of this Waiver and are releasing Making Waves Okoboji, LLC and its affiliates of responsibility.

Acknowledgment of Risks

As the “Booking Passenger/Person” I acknowledge that boating and water-based activities involve inherent risks, including but not limited to: changing weather and water conditions, waves and currents, collision with other vessels or objects, capsizing, falling overboard, drowning, hypothermia, marine life hazards, equipment failure, and operator error. These risks may result in injury, illness, death, or property loss.

Booking Passenger/Person  Responsibility

I, as the “Booking Passenger/Person” and the person who organized this trip/party (the “Booking Passenger/Person”), accept full responsibility for the supervision, conduct, safety, and actions of all guests, crew, invitees, and minors associated with my booking while on board or participating in related activities. I agree to ensure all guests follow safety instructions and the Captain’s and/or Crew’s directions.

Release and Waiver of Liability — Making Waves Okoboji, LLC

To the fullest extent permitted by law, I, on behalf of myself, my guests, my crew, minors for whom I am responsible, and our heirs, executors, administrators, assigns and legal representatives, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Making Waves Okoboji, LLC, its owners, captains, crew, agents, affiliates, insurers, and their officers, directors, employees, representatives, and volunteers (collectively, “Making Waves Okoboji, LLCi”), from any and all claims, demands, causes of action, liabilities, losses, damages, costs, or expenses (including attorney fees) arising out of or related to my booking, the conduct of my guests or crew, or my participation in the cruise, whether caused by negligence of Making Waves Okoboji, LLC or otherwise, including but not limited to personal injury, property damage, or death.

Indemnification — Responsible Person

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Making Waves from any and all claims, suits, losses, liabilities, damages, or expenses (including attorney fees) arising out of or related to the actions or omissions of me, my guests, my crew, invitees, or minors for whom I am responsible.

No Responsibility for Making Waves Okoboji, LLC

I acknowledge and agree that Making Waves is not responsible for supervising my guests or crew, policing conduct, providing security for my personal property, or guaranteeing my party’s compliance with safety rules beyond the captain’s lawful direction. I accept sole responsibility for all risks arising from my booking and party.

Medical Treatment and Costs

I authorize Making Waves to obtain emergency medical care for any participant if deemed necessary. I agree the Responsible Person and/or injured party is responsible for all costs of such care and transportation. Making Waves is not obligated to provide medical care.

Personal Property

I and my guests are solely responsible for personal property brought onto the vessel (including phones, cameras, eyewear, and clothing). Making Waves is not responsible for loss, theft, or damage.

Minors and Parental/Guardian Consent

If minors are included in my booking, I certify I have the legal authority to supervise them and are fully responsible for them: and furthermore, Making Waves Okoboji, LLC in its entirety are not responsible for minor passengers. A parent or legal guardian must sign for each minor, consenting to all terms of this Waiver.

Compliance with Captain’s Lawful Directions

I, and my guests, will comply with the Captain’s lawful directions for safety and vessel operation. The captain may remove anyone who is intoxicated, unsafe, or noncompliant; such removal may occur without refund. Removal and its consequences are the responsibility of the “Responsible Passenger/Person” and removed individuals.

Severability; Governing Law

If any provision is held invalid or unenforceable, remaining provisions remain in full force. This Waiver is governed by the laws of the State (Iowa, USA)  where the cruise departs.

Acknowledgment of Understanding

I acknowledge that I have read this Waiver, fully understand its terms, and sign voluntarily. I understand this Waiver limits legal rights, including the right to sue Making Waves Okoboji, LLC.
